Reconstructing Human Rights

The first in a forum on Joe’s recently released Reconstructing Human Rights: A Pragmatist and Pluralist Inquiry in Global Ethics (Oxford University Press, 2016). A number of commentaries will follow in the coming days.


hoover-reconstructing-human-rights-cover1Earlier this year I visited Sylvia’s Corner, the home of the Focus E15 campaign, to give a talk about the human right to housing. As I shared my research, based on work I had done with housing campaigns in Chicago and Washington DC, I was struck by how this specific moment illustrated what I most hope Reconstructing Human Rights might accomplish—namely, helping to reconstruct human rights as a more democratic idea, and practice.

In London, Focus E15 has been fighting for the human rights of those struggling to secure a decent home for themselves and their families, often struggling against the very public agencies who should be assisting them. Their work not only draws on an ethical and political language of human rights, but it also remakes that language, renders it suitable to their needs and responsive to their experiences. I have witnessed this same process with other campaigns, such as the  Chicago Anti-Eviction Campaign, and with community organising groups like ONE DC in Washington DC. It was revealing to act, even briefly, as a conduit through which the experiences of these distant groups could be relayed. Human rights are constantly being remade, repurposed—reconstructed—to serve the ends of those suffering from injustice. It is this reality that motivates my book, which is at its core an attempt to understand how human rights can be both an instrument of the privileged and powerful, and also a weapon for the oppressed and disempowered. I wrote this book because I wanted to know, what should we make of human rights?

Something in the Way of Things

Hip-Hop Head

When you look at it head on, from just the right distance, the world seems solid. The order of things presents itself as impenetrable. Yet a change in the angle of vision reveals fissures, fusions, flukes – a world of pieces shifting ceaselessly. One vision of the world promises stability and order, the other freedom and creativity. Which of these is more attractive depends on where one finds oneself: pressed upon by the weight of the world, or abraded by the shifting fragments.

Which of these worlds is real? This is the metaphysician’s diagnosis: “If you want to calm your nerves, then find the arrangement of the world as it really is.” But the physician can only prescribe convalescence or catharsis: “Accept the reality of the given world or realise the subliminal essence of the immanent world.” This regiment exhausts us rather than making us well. It lacks the vigour of creative activity. We don’t need to know; we need to make.

William Connolly suggests that the political condition of late-modernity is to experience this impasse without means to bridge the gap.

In our times we can neither endure our thoughts nor the task of rethinking them. We think restlessly within familiar frameworks to avoid thought about how our thinking is framed. Perhaps that is the ground of modern thoughtlessness.

Creativity requires us to leave the metaphysician behind – the making of the world requires dreams, contradictions, promises, lies, empty space, messy abundance. Turning away from knowing does not force us to apologise for the durable architecture of the world – this is the vice of Richard Rorty’s ironic liberalism. He calls on poets of the self to write their lines on the walls of the world as if they were solid, so not to upset things too much – a consolation of the comfortable, irony in the face of human disaster.

The condition of the world impels those caught between the monuments of the given to return to the fissures, fusions and flukes, in hopes of exercising our creativity on the social architecture. We need world makers. We need lovers.

It is with these thoughts in mind that I return to The Roots. Phrenology, the follow-up to Things Fall Apart, explores the creative challenge the band faced after producing an album that reconstructed hip-hop – trying to avoid becoming a parody of themselves or reducing their message to braying didactic verses. The difficulty of achieving real creativity is political as well as artistic and it demands not knowledge but love, desire and risk; it is the Roots’ exploration of how to make worlds anew that offers up lessons of wider import.

Feminist Notes, part I

By including what violates women under civil and human rights law, the meaning of “citizen” and “human” begins to have a woman’s face. As women’s actual conditions are recognized as inhuman, those conditions are being changed by requiring that they meet a standard of citizenship and humanity that previously did not apply because they were women. In other words, women both change the standard as we come under it and change the reality it governs by having it applied to us. This democratic process describes not only the common law when it works but also a cardinal tenet of feminist analysis: women are entitled to access to things as they are and also to change them into something worth our having.

Thus women are transforming the definition of equality not by making ourselves the same as men, entitled to violate and silence, or by reifying women’s so-called differences, but by insisting that equal citizenship must encompass what women need to be human, including a right not be sexually violated and silenced. This was done in the Bosnian case by recognizing ethnic particularity, not by denying it. Adapting the words of the philosopher Richard Rorty, we are making the word “woman” a “name of a way of being human.” We are challenging and changing the process of knowing and the practice of power at the same time.

Human Rights Contested – Part I

The central tension of human rights is that they propagate a universal and singular human identity in a fragmented political world. No one writing about human rights ignores this tension, but the most important question we face in judging the value of human rights is how to understand this tension and the divisions it creates. The expected divisions between good and evil, between moral universalists and dangerous relativist, between dignified interventionists and cowardly apologists, have long given shape to human rights, as both an ideal and a political project. Seeing the problems of (and for) human rights in these habituated ways has dulled our capacity for critical judgment, as few want to defend evil or violent particularisms or advocate passivity in the face of suffering. Even among serious and determined critics our inherited divisions are problematic (and increasingly over rehearsed), whether we think of human rights as the imposition of Western cultural values, or in terms of capitalist ideology serving the interests of neo-liberal elites, or as an expression of exceptional sovereign power at the domestic and global levels. The ways that these divisions deal with the tension at the heart of human rights misses the ambiguity of those rights in significant ways.

     Rather than trying to contain the tensions between singularity and pluralism, between commonality and difference, in a clear and definitive accounting, the authors of the texts reviewed here allow them to proliferate. Rather than trying to resolve the problem of human rights, they attempt to understand human rights in their indeterminate dissonance while exploring what they might become. To create and invoke the idea of humanity is not a political activity that is unique (either now or in the past) to the ‘West’. The people most dramatically injured by global capitalism sometimes fight their oppression by innovating and using the language and institutions of human rights. Political exceptions – the exclusion of outsiders, humanitarian wars and imperialist conceits – are certainly enabled by the same sovereign power that grants rights to its subjects, which is a metaphorical drama all too easily supported by human rights, but it is only a partial telling of the tale, a telling that leaves out how human rights can reshape political authority and enable struggles in unexpected ways. The work of these authors pushes us to reject the familiar divisions we use to understand the irresolvable tension at the centre of human rights and see the productive possibilities of that tension. If human rights will always be invoked in a politically divided world, and will also always create further divisions with each declaration and act that realises an ideal universalism, then our focus should be on who assumes (and who can assume) the authority to define humanity, the consequences for those subject to such power, and the ends toward which such authority is directed. What We (Should Have) Talked About at ISA: The Politics of Humanity and The Ambiguous History of Human Rights – Part III

This is the final post in a series laying out a set of interrelated arguments I presented at this year’s ISA conference. The first post looked at the nature of human rights claims, while the second considered how rethinking human rights in terms of contestation over the ambiguous meaning of humanity as a political identity affects our understanding of the history of human rights. In the final post I suggest a positive ethos, enabled by attending to human rights in terms of agonism and pluralism.

Human Rights as a Democratising Ethos

In part 1, I analysed human rights as an attempt to offer a universal moral justification of political authority. This is a perennial political question, but one which is reconfigured by talk of “human rights”, as the political identity of humanity opens up question over who is included in political community, as well as the boundaries that define such communities. The stakes of the question of human rights – offering a universal account of who is included as a rights bearing member of the political community, and the legitimate order of that community – lead to a profound anxiety over justifications. The moral reasons we have to uphold human rights should be weighty, powerful and certain – or so the logic dictates.

What emerges from this logic is an essentially legislative understanding of human rights, in which moral principles give justification for the necessary and minimal law to grant legitimacy to the universal vision of both individual and community. If this moral law is to be more than an imposition of power, a merely effective positive law, it must involve a universal moral appeal that cannot be denied in order to secure human rights as the necessary law of legitimate authority. In this regard Habermas’ defense of moral universality and human rights are indicative and sophisticated examples. (Habermas 1992, 1998)
